Terms and Conditions for Silent Auction

1. Binding Nature of the Bid

   By placing a bid on the website, you confirm your acceptance of these terms and conditions. Each bid placed is considered binding and irrevocable. The bidder agrees to honor the bid amount if it is declared the winning bid.

2. Eligibility

   Participation in the auction is restricted to individuals aged 18 years and above. By bidding, you confirm that you meet this requirement.

3. Auction Process

   • The auction will begin and end at the dates and times specified on the website.
   • Bidders are required to register on the website and provide accurate and complete information.
   • Bidding is conducted anonymously; the identity of bidders will not be disclosed.

4. Winning Bid

   • The highest bid received by the auction’s closing time will be deemed the winning bid, provided it meets or exceeds the reserve price (if applicable).
   • The winner will be notified via email or other contact details provided during registration.

5. Payment and Ownership Transfer

   • Payment for the winning bid must be completed within the stipulated time mentioned in the notification. Failure to make the payment may result in the cancellation of the bid and forfeiture of participation in future auctions.
   • Ownership of the artwork will transfer to the bidder only after full payment has been received.

8. Cancellation of Bids

   • Bidders may not cancel their bids once placed.

9. Artwork Description

   All artworks are sold "as is." While every effort is made to provide accurate descriptions and images, the gallery does not warrant the accuracy of such information.

10. Limitation of Liability

    The gallery is not liable for any technical issues, delays, or disruptions that may affect the auction process.

11. Force Majeure

    The gallery is not responsible for any failure to perform its obligations due to circumstances beyond its control, including but not limited to natural disasters, technical failures, or regulatory changes.

12. Dispute Resolution

    Any disputes arising from the auction will be resolved in accordance with Indian law. The courts of Mumbai, India, shall have exclusive jurisdiction.
